How to qualify for an E-3 visa<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must demonstrate, among other things, that you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Are you a citizen or national of Australia with a valid Australian passport<\/li>\n\n\n\n<li>Have a legitimate offer of employment in the United States<\/li>\n\n\n\n<li>Will fill&nbsp;a position that qualifies as a \u201cspecialty occupation\u201d<\/li>\n\n\n\n<li>Possess the necessary academic or other qualifying credentials\n<ul class=\"wp-block-list\">\n<li>This tends to mean a bachelor&#8217;s degree or higher, or a level of experience difficult to obtain.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>You must intend to leave the United States upon the termination of your status\n<ul class=\"wp-block-list\">\n<li>However, you do not have to maintain a foreign residency while you are in the United States<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Have a certified Labor Condition Application (LCA) from the Department of Labor:<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/ETA\/oflc\/pdfs\/ETA_Form_9035CP.pdf\">https:\/\/www.dol.gov\/sites\/dolgov\/files\/ETA\/oflc\/pdfs\/ETA_Form_9035CP.pdf<\/a><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your employer must sign the LCA to guarantee specific requirements are being met at work:\n<ul class=\"wp-block-list\">\n<li>You are being hired without causing a labor dispute<\/li>\n\n\n\n<li>You are being hired without negatively affecting employees comparable to you<\/li>\n\n\n\n<li>You are being paid fairly while on an E-3 visa.\n<ul class=\"wp-block-list\">\n<li>You cannot be paid more or less than your colleagues for doing work of similar difficulty<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Your LCA could not have been granted more than two years before your start date at your new job<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"2\"><strong><em>2. What are the benefits of an E-3 visa?<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Only Australian nationals are permitted to use the E-3 visa, making for a small pool of applicants.<\/li>\n\n\n\n<li>10,500 E-3 visas are made available each year.\n<ul class=\"wp-block-list\">\n<li>There have never been as many E-3 visas applied for or issued as are made available.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The E-3 visa is less expensive and has fewer applications than the H1B visa, making it easier to get.<\/li>\n\n\n\n<li>E-3 status is available for a maximum of two years and is renewable forever.<\/li>\n\n\n\n<li>You may bring your dependent spouse and unmarried children under the age up 21.\n<ul class=\"wp-block-list\">\n<li>Your children can attend school<\/li>\n\n\n\n<li>Your spouse is allowed to work under an Employment Authorization Document (EAD)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"3\"><strong><em>3. The process of applying for an E-3 visa<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Applying Overseas<\/strong>\n<ul class=\"wp-block-list\">\n<li>You should hire an immigration lawyer to help you determine what is needed, fill out all the paperwork, and deliver your application to the United States consulate or embassy.\n<ul class=\"wp-block-list\">\n<li>Your lawyer needs to submit <strong>The Online Nonimmigrant Visa Application, Form DS-160,<\/strong> on your behalf: <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/visa-information-resources\/forms\/ds-160-online-nonimmigrant-visa-application.html\">https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/visa-information-resources\/forms\/ds-160-online-nonimmigrant-visa-application.html<\/a><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Arrange a face-to-face meeting with a consular officer once you have delivered your application.\n<ul class=\"wp-block-list\">\n<li>Your lawyer should help you prepare for the interview.<\/li>\n\n\n\n<li>You will be asked questions on your E-3 employment, your past, your immigration plans, etc.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Applying in the United States<\/strong>\n<ul class=\"wp-block-list\">\n<li>If you are in the United States on the Visa Waiver Program (where you do not need a visa if you are only in the United States for 90 days or less) and are selected for a job that will sponsor you as an E-3 nonimmigrant,\n<ul class=\"wp-block-list\">\n<li>you will have to leave the United States to apply for your E-3 visa.\n<ul class=\"wp-block-list\">\n<li>You do not have to go all the way to Australia.<\/li>\n\n\n\n<li>Many consuls in Europe and Canada will issue an E-3 visa.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>If you have been a legal nonimmigrant under a different visa, you can submit a &#8220;change of status.\u201d\n<ul class=\"wp-block-list\">\n<li>Unfortunately, you are not eligible for premium processing with an E-3 visa<\/li>\n\n\n\n<li>Even though it takes longer to apply for a change of status rather than to leave the country and apply for a visa through a consul, you can remain in the United States during processing, which will save you the cost of flights to and from the United States.<\/li>\n\n\n\n<li>Also, if you stay in the country, you can apply for your spouse&#8217;s job authorization.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"4\"><strong><em>4. E-3 visa processing time<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Changes of status can take four to eight months to process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The season\/time of year can affect your visa application.
