    1. What is the EB-1A visa? <\/em><\/strong><\/p>\n\n\n\n

    An EB-1A visa is a non-immigrant visa for citizens that have exceptional talent in particular fields. The EB-1A visa is for foreign people who have exceptional talent in the arts, sciences, business, education, or athletics. It will require you to demonstrate both your ability and intention to work in your field once you arrive in the United States.<\/p>\n\n\n\n

    2. What are the benefits of the EB-1A visa? <\/em><\/strong><\/p>\n\n\n\n

      \n
    • You can legally work in the United States and will not need a sponsor.<\/li>\n\n\n\n
    • You can apply for the EB-1A visa without a Labor Certification, or a work offer from the U.S. Additionally, you can self-petition for an EB-1A visa (meaning that you can apply without a company sponsoring you).<\/li>\n\n\n\n
    • If your EB-1A visa is approved, you are eligible for a U.S. green card.<\/li>\n\n\n\n
    • If your EB-1A visa is approved, your spouse and unmarried children under the age of 21 may also receive their green cards.<\/li>\n<\/ul>\n\n\n\n

      3. What are the requirements to get an EB-1A visa?<\/em><\/strong><\/p>\n\n\n\n

      3 things must be demonstrated to obtain an EB-1A visa:<\/p>\n\n\n\n

        \n
      • You must possess exceptional talent in the arts, business, education, or athletics.<\/li>\n\n\n\n
      • You are moving to the U.S. to continue working in your field of expertise.<\/li>\n\n\n\n
      • That coming to the United States will be beneficial for the country.<\/li>\n<\/ul>\n\n\n\n

        4. The process of applying for an EB-1A visa<\/em><\/strong><\/p>\n\n\n\n

        You must show proof of your achievements and that they have been acknowledged in your field of expertise. There are 2 ways to prove this:<\/p>\n\n\n\n

          \n
        • Evidence of a one-time achievement. An example of these is The Nobel Peace Prize, an Academy Award, a Grammy, and other one-time awards.<\/li>\n\n\n\n
        • OR evidence that you meet 3 of the 10 criteria for an EB-1A visa:\n
            \n
          • Less prestigious honors or awards recognized nationally or globally for achievement in your field of activity.<\/li>\n\n\n\n
          • Memberships in organizations of your field that demand exceptional accomplishments from its members as determined by reputable national or worldwide authorities in their field of specialty.<\/li>\n\n\n\n
          • Journals about you regarding your work in your field in a significant trade publication or other big media.<\/li>\n\n\n\n
          • Participation as a judge of the work of others in the same or a related field of specialty either as an individual or as a member of a panel.<\/li>\n\n\n\n
          • Original and significant contributions to science, literature, the arts, or business.<\/li>\n\n\n\n
          • Writing academic essays on your subject for major professional magazines, trade journals, or other media.<\/li>\n\n\n\n
          • The presentation of your work in your specialty in exhibits or shows for the arts.<\/li>\n\n\n\n
          • You have contributed in a significant or influential way to businesses or organizations with a prestigious reputation.<\/li>\n\n\n\n
          • You have received a high salary or high compensation for your services.<\/li>\n\n\n\n
          • You\u2019ve had commercial success in the performing arts, as seen by sales of records, cassettes, CDs, and videos as well as box office revenue.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n

            If neither of these categories applies to your field of remarkable ability, you may provide equivalent proof to show your eligibility for an EB-1A visa.<\/strong><\/p>\n\n\n\n

            For instance, even if you are a chef of international repute, you might not have proof of your financial success. Instead, you could have proof of a cookbook you wrote and became a commercial success. It is critical to demonstrate why the criteria do not apply to your case and why the evidence you supplied should be accepted as a replacement.<\/p>\n\n\n\n

            The EB-1A visa is eligible for premium processing:<\/strong><\/p>\n\n\n\n

            If you decide to pay extra for premium processing, USCIS will examine your petition and respond within 15 days. The premium processing charge is $2,500 and if you qualify, you may receive a 15-day evaluation and response to your petition. Double-check the official USCIS to stay up to date with fees since they may change at any time.<\/p>\n\n\n\n

            5. What are the documents required for the EB-1A visa?<\/em><\/strong><\/p>\n\n\n\n

            Depending on your achievements, publications, honors, etc., your immigration lawyer will need certain documentation from you. The list of common papers that you will need to give your immigration lawyer are:<\/p>\n\n\n\n

              \n
            • Your resume or CV.<\/li>\n\n\n\n
            • Copies of your passport for you and your family.<\/li>\n\n\n\n
            • Evidence of your abilities such as copies of your publications, awards, pay stubs, and citations.<\/li>\n\n\n\n
            • Letters of recommendation and endorsement from experts and professionals in your field.<\/li>\n\n\n\n
