What is the EB-1B visa?<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The EB-1B visa is a type of immigration visa designated for exceptional academics and researchers. You must have at least 3 years of experience conducting academic research or teaching in your specialty to be eligible for an EB-1B visa. Additionally, you will need to demonstrate that you are exceptional in a particular academic field per international standards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"2\"><strong><em>2. What are the benefits of the EB-1B visa? <\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You do not need a work certification.<\/li>\n\n\n\n<li>The EB-1B visa makes you eligible to apply for a green card for yourself, your spouse, and your kids.<\/li>\n\n\n\n<li>Your spouse and children can obtain green cards, work authorization, and admission to American universities.<\/li>\n\n\n\n<li>You can enter and exit the U.S. with a green card.<\/li>\n\n\n\n<li>It has a lower standard than the EB-1A visa.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"3\"><strong><em>3. What are the requirements to get an EB-1B visa?<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must demonstrate that you are an excellent academic who is recognized internationally to be eligible for an EB-1B visa. There are 3 primary conditions to be eligible for an EB-1B visa:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You must meet at least two of the following six evidential requirements to demonstrate that you are an extraordinary individual who is known internationally:\n<ul class=\"wp-block-list\">\n<li>You\u2019ve won significant honors or prizes for your remarkable performance in your academic field.<\/li>\n\n\n\n<li>You are a member of organizations in your academic field that only admit members who have demonstrated exceptional success.<\/li>\n\n\n\n<li>There is written content that others have published regarding your academic work in trade magazines.<\/li>\n\n\n\n<li>You have taken part, individually or as a member of a board, in the evaluation of the work in your academic area or a related academic subject.<\/li>\n\n\n\n<li>You\u2019ve made innovative contributions to academic or scientific study in your field.<\/li>\n\n\n\n<li>You have written academic books or papers for scholarly publications in your field of study.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>You may offer similar evidence to demonstrate your eligibility for an EB-1B visa if one of the requirements specified above does not apply to the evidence you want to submit. The honor should be acknowledged nationally and awards that you received as a student will not qualify. Your work should show that you are recognized as a leader in your area on a global scale<em>.<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You must have at least 3 years of experience teaching\/and or doing research in your academic field.<\/li>\n\n\n\n<li>You must have a job offer from a U.S. employer to work as a permanent researcher or as a teacher to be eligible for an EB-1B visa. Alternatively, you need to have been given a job offer to work as a permanent researcher for a private company in your academic field.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>To simplify this, you need either:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A job offer from a university or institute of higher education as a teacher<\/strong><\/li>\n\n\n\n<li><strong>A job offer from a university or institute of higher education as a researcher<\/strong><\/li>\n\n\n\n<li><strong>A job offer from a private employer as a researcher<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"4\"><strong><em>4. The process of applying for an EB-1B visa<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The supporting materials you include with your EB-1B petition are crucial. Your accomplishments, credentials, and qualifications will determine which papers you should submit. Here is a list of some of the documents you should expect to include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Awards<\/strong> \u2013 Include the awards you have received for your work.<\/li>\n\n\n\n<li><strong>Evidence of membership in associations<\/strong> \u2013 If you belong to a professional organization in your industry, you should provide a letter or card of identification that attests to your membership.<\/li>\n\n\n\n<li><strong>Letter from a former employer<\/strong> \u2013 Your qualifications as a researcher or instructor should be outlined in this letter. It should be written on company letterhead and signed by an authorized representative of the company.<\/li>\n\n\n\n<li><strong>Job offer from U.S. employer <\/strong>\u2013 Your U.S. employer\u2019s job offer must be in writing. Employment offers made orally will not be accepted.<\/li>\n\n\n\n<li><strong>Letters of Endorsement<\/strong> \u2013 Letters of support from authorities in the industry are important when applying for the EB-1B petition. These letters explain your significance and effect on your profession. All the letters must come from outsiders to you.<\/li>\n\n\n\n<li><strong>Copy of Passport<\/strong><\/li>\n\n\n\n<li><strong>Resume<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"5\"><strong><em>5. What is the process of getting an EB-1B visa?<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The EB-1B visa application is summarized as follows:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Step 1: Hire an immigration attorney.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your immigration attorney will decide if the EB-1B choice is the best one for you. Your immigration attorney will submit this form on your behalf together with all necessary supporting documentation, including your awards and letters of recommendation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Application <\/em><\/strong><a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-140.pdf\"><strong><em>Form I-140<\/em><\/strong><\/a><strong><em>, Immigration Petition for Alien Workers:<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-140.pdf\">Form I-140, Immigrant Petition for Alien Workers (uscis.gov)<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Step 3: Adjustment of Status or Visa Processing<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>There are two 2 options for step 3:<\/em><\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Adjustment of Status<\/li>\n\n\n\n<li>Visa Processing<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The term \u201cstatus adjustment\u201d refers to changing from a non-immigrant to an immigrant status.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"6\"><strong><em>6. How does USCIS decide whether you are outstanding in your field?<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When determining whether you are internationally recognized as outstanding in your field, USCIS follows a two-step process:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Step 1: Evidentiary Threshold<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At this stage, USCIS is considering whether you genuinely have enough proof to meet at least two of the six evidentiary requirements outlined above. Your petition will be rejected if you don\u2019t meet at least two requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Step 2: Final Merits Determination<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this phase, USCIS is evaluating your qualifications.
