What is an employer-sponsored green card?

There are several options for a foreign individual to become a permanent resident in the United States (green card holder). Some choices require you to invest in a business in the United States. If you have direct family members who are U.S. citizens or if you marry a U.S. citizen, you have certain possibilities. Other possibilities are available for people who have a job offer from a U.S. firm that is prepared to sponsor their green card; this is known as an employer-sponsored green card.

A United States corporation (your employer) will file numerous immigration paperwork with the United States Citizenship and Immigration Services (USCIS) on your behalf to get an employer-sponsored green card. Your employer is the petitioner (the person who submits the immigrant petition to USCIS), and you are the beneficiary (the party directly receiving immigration benefits).

Your employer is considered your sponsor based on the acts they perform on your behalf.

2. What is the process of getting an employer-sponsored green card?

Obtaining an employer-sponsored green card consists of three steps. First, your employer must get a Labor Certification from the United States Department of Labor (DOL). Second, on your behalf, your company must file an immigration petition (Form I-140). Third, you must either modify your status (Form I-485) or apply for your immigrant visa (Form DS-260).

Labor certification

The first step in obtaining a green card through employer sponsorship is for your company to obtain an acceptable labor certification from the U.S. Department of Labor (DOL). This procedure is also known as PERM. The immigration laws are intended to safeguard the interests, earnings, and working conditions of the American worker. As a result, before you may come to the United States, the DOL must verify that there is a labor shortage.

This process forces your company to test the U.S. labor market to discover whether there are any suitable U.S. workers available to fill the post that they are giving you. Your company must make good faith attempts to hire a qualified U.S. worker by promoting the relevant employment opportunity and taking into account the credentials of all U.S. applicants.

In addition, your business must obtain a prevailing pay decision from the National Prevailing Wage Center by submitting Form ETA 9141. The Department of Labor requires your company to file an Application for Permanent Labor Certification (Form ETA-9089).

Immigrant Petition

Once your employer’s labor certification application has been granted, you may go on to the next stage in the process, which is to file the immigrant visa petition with U.S. Citizenship and Immigration Services (USCIS). Employer-sponsored green cards are classified into two visa categories: EB-2 and EB-3. The suitable category will be determined by the employment requirements and the beneficiary’s particular qualifications.

EB-2: If the employee needs a graduate degree, this category is often acceptable. An advanced degree is higher than a baccalaureate degree in the United States (or its international equivalent).

EB-3: If the employer demands a professional, skilled worker, or unskilled laborer, this category is often acceptable. A “professional” usually has a bachelor’s degree from the United States or a foreign equivalent. A “skilled worker” is someone who can perform skilled labor (labor that requires at least 2 years of experience or training). Someone capable of performing unskilled tasks is referred to as an “unskilled worker” (labor that requires less than 2 years of experience or training).

Your employer files the immigration petition (Form I-140). The form, together with any supporting papers, is delivered to USCIS.

Adjustment of status or immigrant visa processing

Adjustment of status: The procedure for changing your present status to permanent resident status is known as an adjustment of status. You must complete Form I-485 with USCIS to modify your status. The entire procedure takes place in the United States. You must be physically present in the United States to change your status. In many circumstances, you can file your adjustment of status application with your immigrant visa petition. By filing both forms together, you can substantially minimize total processing time. To save time it is recommended that you submit Form I-693, Report of Immigration Medical Examination and Vaccination Record, at the same time you file to adjust your status. Form I-693 generally remains valid for 2 years after the date signed by the doctor.

Immigrant visa processing: The process of getting an immigrant visa at a U.S. consulate or embassy overseas is known as immigrant visa processing. To obtain your immigrant visa, you must submit a Form DS-260 online. You will also be needed to attend an immigrant visa interview at your home country’s U.S. consulate or embassy. After you complete the interview, you should receive an immigrant visa within a week. If you are not physically present in the United States and are thus not qualified to modify your status, an immigrant visa procedure is usually done. To complete a form online visit: Immigrant Visa – Sign In (state.gov) and follow the instructions.

4.
