Failure to correctly submit your case or to complete all of the appropriate processes may result in your case being delayed or, worse, rejected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedures for obtaining a green card by marriage vary slightly depending on whether you marry a U.S. citizen or a U.S. permanent resident. Instead, the <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-130.pdf\">I-130<\/a> serves as the foundation for your green card application. This can be accomplished in two ways: status adjustment or consular processing. Each of these alternatives has its own set of criteria. The choice you make will be determined by your specific circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Adjustment of Status<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An adjustment of status is the process of transforming your existing status in the United States to permanent resident status. This procedure is completed entirely in the United States by submitting <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-485.pdf\">Form I-485<\/a> to USCIS. In many circumstances, you can file <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-485.pdf\">Form I-485<\/a> with <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-130.pdf\">Form I-130<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Requirements for Adjustment of Status:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You must have lawfully entered the United States.<\/li>\n\n\n\n<li>At the moment the <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-485.pdf\">I-485<\/a> is submitted, you are physically present in the United States.<\/li>\n\n\n\n<li>You cannot be denied entry into the country. The process of applying for an immigrant visa at a U.S. consulate or embassy abroad is known as consular processing. Form DS-260 must be completed and submitted to apply for an immigrant visa. For more information on Form DS-260, <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/visa-information-resources\/forms\/online-immigrant-visa-forms.html\">click here<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Requirements for applying for an immigrant visa:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-130.pdf\">Form I-130<\/a> form must be approved.<\/li>\n\n\n\n<li>You cannot be denied entry to the United States because of any of the ten categories of inadmissibility (criminal convictions, health issues, etc.)<\/li>\n\n\n\n<li>You must currently be eligible for a visa.<\/li>\n\n\n\n<li>You must have a medical checkup performed by a qualified doctor.<\/li>\n\n\n\n<li>You will be required to attend an interview at a U.S. consulate or embassy. During the interview, the immigration official will go over your marriage case records, medical examination findings, and other relevant evidence. They may also interrogate you about your marriage to ascertain its legitimacy.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">After a successful consular interview, an immigrant visa will be attached to your passport within a week. You can enter the United States using an immigrant visa. Depending on your status, you will be classified as a conditional permanent resident or an \u201cunconditional\u201d permanent resident upon entry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Conditional Permanent Resident Status<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you marry a U.S. citizen or permanent resident and become a permanent resident during the first two years, you are considered a \u201cconditional\u201d permanent resident for two years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you have been married for two years or more at the time you apply for permanent residency, you will be considered an \u201cunconditional\u201d permanent resident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You enjoy the same rights and advantages as other permanent residents as a conditional permanent resident. A permanent residency card (\u201cgreen card\u201d) will be provided to you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During these 2 years, USCIS has the authority to revoke your conditional green card if it determines that the marriage was not valid or if the marriage ends before the end of the 2 years (through divorce or annulment).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Removal of condition to become an unconditional permanent resident<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must file a joint petition to have the condition lifted from your permanent resident status at the end of the two years of conditional permanent residence. To become an unconditional permanent resident, you must submit <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-751.pdf\">Form I-751<\/a> to USCIS. You have 90 days before your two-year conditional resident status expires to file <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-751.pdf\">Form I-751<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-751.pdf\">Form I-751<\/a> must be submitted jointly. This implies that both parties must sign the petition and certify that the marriage was legal. However, in some cases, you may be able to get a waiver of the joint filing requirement. This allows you to file <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-751.pdf\">Form I-751<\/a> without the presence of your U.S. citizen or lawful permanent resident spouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here are the reasons why USCIS may grant a waiver of the joint filing requirement:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A U.S. citizen or lawful permanent resident spouse has died.<\/li>\n\n\n\n<li>The U.S. citizen subjected the conditional permanent residence to violence or excessive cruelty.<\/li>\n\n\n\n<li>The marriage has terminated as a result of divorce or annulment.<\/li>\n\n\n\n<li>Extreme hardship<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Documents to submit with <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-751.pdf\">Form I-751<\/a><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A leasing agreement or mortgage document indicating a shared house<\/li>\n\n\n\n<li>Proof of joint bank accounts (commingled funds)<\/li>\n\n\n\n<li>Children born during the marriage\u2019s birth certificates<\/li>\n\n\n\n<li>Signed declarations from friends and relatives who have intimate knowledge of the marriage\u2019s authenticity<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Once the form is accepted, you will be considered an unconditional permanent resident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Naturalization (Optional)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Naturalization is the process of applying for and becoming a citizen of the United States. While naturalization is not essential to become a U.S. citizen, as a permanent resident, you are entitled to apply. After 5 years as a permanent resident, you are entitled to naturalize. Your conditional permanent resident status counts toward the five years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here are some of the requirements to naturalize:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You must be 18 years old or older when you file your naturalization application<\/li>\n\n\n\n<li>Your green card must be valid for at least 5 years<\/li>\n\n\n\n<li>You must have spent at least three months in the state where you are filing for citizenship<\/li>\n\n\n\n<li>You must have lived in the United States for at least 30 months in the five years before the filing of your naturalization application<\/li>\n\n\n\n<li>You must be of sound moral character<\/li>\n\n\n\n<li>You should have a fundamental knowledge of U.S. government history<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Before filing your naturalization application, you must have continuously resided in the United States for at least 5 years (no continuous absences for 180 days or longer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"4\"><strong><em>4.
